1. Acceptance of These Terms
The Skillable AI Mentor (“Mentor”) is an AI-powered chat assistant embedded in the Skillable platform for use with your labs. By opening the Mentor tab, granting any Mentor permission, or sending a message to the Mentor, you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Mentor — your lab remains fully usable without it.
These Terms supplement, and do not replace, any MSA or other agreement that governs your access to or hosting of the lab itself (for example, your organization’s agreement with Skillable or the lab provider’s terms of service) (“Agreement”). If the terms of any Agreement conflict with these Terms, then these Terms shall prevail in relation to the Mentor. Capitalized terms not defined in these Terms are defined in the Agreement.
Use of the Mentor may result in Skillable receiving or processing personal information. For details on how Skillable processes personal data, please see the Skillable Privacy Policy at https://www.skillable.com/company/legal-and-security/privacy/.
2. What the Mentor Is
The Mentor is an artificial-intelligence assistant designed to help you complete the lab you are working in. It is grounded in the lab’s instructions and environment and can, with your permission, see lab information, capture screenshots, run commands you approve, and consult anonymized support history. It is a learning aid — not a human tutor, not an official source of record for the lab content, and not a support channel of last resort.
3. Your Permission Choices
Before the Mentor responds for the first time in a session, you may be asked to allow or decline specific capabilities such as:
- Access information about this lab — lab name, page instructions, environment facts.
- Take screenshots when needed — capture the lab screen or read images you attach.
- Run commands or actions in the lab environment — type commands into the lab terminal or navigate pages, only when you click an action button.
- Research Skillable support history — consult anonymized patterns from past learner reports (off by default).
The Mentor honors your choices for the duration of the session. You would need to reselect your choices when you start a new session. Granting a capability constitutes your agreement to the data flows it describes, including the silent capture of lab screenshots when your question calls for visual context (if you allowed screenshots) and the other flows described in these Terms or made available from time to time. You may change your choices by refreshing the lab.
4. AI-Generated Content — No Guarantee of Accuracy
The Mentor’s responses are generated by a large language model. They may be incomplete, outdated, or incorrect, and may not reflect any correct, optimal, officially graded, or intended solution to a lab step.
- Verify before you act. You are responsible for reviewing any command, code, or guidance the Mentor provides before using it — especially before clicking a button that executes a command in your lab environment.
- The Mentor’s answers are not professional, legal, security, compliance, or certification advice.
- Where the Mentor’s guidance conflicts with the lab instructions or those of any applicable instructor, the lab instructions and those of the applicable instructor prevail.
5. Actions in Your Lab Environment
When you have allowed it, the Mentor can present one-click buttons that run a command in your lab environment or navigate you to another instructions page. Actions run only when you click them. By clicking an action button, you direct the execution of that command and accept responsibility for its effect on your lab environment, including any damage to, loss of, or impact on your progress, score, or environment state. Lab environments are generally disposable training environments; do not use Mentor actions against systems or data outside the lab.
6. Recording of Conversations
All Mentor conversations are recorded. This includes your messages, the Mentor’s replies, screenshots captured or attached during the session, your permission decisions, and usage metadata (such as timestamps and token counts).
Recorded conversations are used to:
- help Skillable running your lab program to see where End Users get stuck and improve lab content;
- operate, secure, troubleshoot, and improve the Mentor service; and
- enforce these Terms.
Access to transcripts is restricted to authorized lab administrators. Transcripts are not visible to other End Users. Retention period: [retention period — e.g., N days/months].
Do not enter sensitive personal information (such as passwords, payment details, government identifiers, or health information), confidential business information, or information about third parties into the Mentor chat. The Mentor does not need it, and conversations are recorded.
7. Data Processing and Subprocessors
Mentor messages and, where permitted, screenshots and lab context are processed by Skillable’s AI infrastructure, which includes Microsoft Azure OpenAI Service operating under Skillable’s Azure subscription. Content you submit to the Mentor is not used by Skillable or Microsoft to train foundation models.
8. Acceptable Use
You agree not to:
- attempt to bypass, override, or “jailbreak” the Mentor’s safety rules, topic boundaries, or usage limits;
- attempt to reverse engineer, extract, or copy lab credentials, other End Users’ data, system prompts, or other confidential information through the Mentor;
- share Mentor responses with any third party outside of your organization;
- use the Mentor for purposes unrelated to the lab, or to generate content that is unlawful, harmful, or infringing;
- inject or introduce into the Mentor any malware, virus, code, software routine, or instructions designed or intended to disable, harm, or otherwise disrupt in any manner any Skillable or third-party computer system, file, or other content;
- use the Mentor to interfere with or disrupt the lab platform, the Mentor service, or other users; or
- resell, scrape, bulk copy, or programmatically access the Mentor outside the sanctioned lab integration.
The Mentor enforces per-session usage limits and rate limits. Skillable may suspend or terminate Mentor access for violations of this section without affecting your access to the lab itself.
9. Service Limitations
The Mentor deliberately cannot end, save, pause, restart, or extend a lab; grade or mark a lab complete; authenticate on your behalf; or access other End User sessions. For those needs, use the lab platform controls or contact your lab administrator or Skillable Support. The Mentor is provided as an optional aid, and may be modified, interrupted, or withdrawn at any time without notice.
10. Intellectual Property
All right, title, and interest in and relating to the Mentor, its software, prompts, and interface are the sole and exclusive property of Skillable and its third-party licensors, including all intellectual property rights and all related patents, copyrights, trade names, trademarks, and trade secrets. Outputs from, and conversations and usage data recorded by, the Mentor are also Skillable’s sole and exclusive property. Subject to these terms, you may use output the Mentor generates for you within your lab work and your own learning. You retain any rights you hold in the content you submit; you grant Skillable a license to use such submitted content for the purposes described in these Terms.
11. Disclaimer of Warranties
THE MENTOR IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY, REPRESENTATION, CONDITION, OR GUARANTEE OF ANY KIND, EXPRESS OR IMPLIED. SKILLABLE DISCLAIMS ANY AND ALL WARRANTIES, REPRESENTATIONS, CONDITIONS, OR GUARANTEES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF TITLE, MERCHANTABILITY, NONINFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE. SKILLABLE DOES NOT WARRANT THAT MENTOR RESPONSES WILL BE CORRECT, THAT THE MENTOR PURCHASED SERVICE WILL BE UNINTERRUPTED, OR THAT USE OF THE MENTOR WILL RESULT IN COMPLETION OF ANY LAB, COURSE, OR CERTIFICATION.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKILLABLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES INCLUDING DAMAGES FOR LOST PROFITS, LOST REVENUE, GOODWILL, LOSS OF DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH USE OF THE MENTOR, INCLUDING RELIANCE ON MENTOR OUTPUT OR EXECUTION OF MENTOR-SUGGESTED COMMANDS. SKILLABLE’S TOTAL AGGREGATE LIABILITY ARISING FROM THE MENTOR WILL NOT EXCEED THE GREATER OF (A) USD $100; OR (B) ANY LIMIT AGREED IN THE APPLICABLE AGREEMENT.
13. Changes to These Terms
Skillable may update these terms from time to time. The current version will be available at [URL] and linked from the Mentor interface. Material changes will be indicated by updating the “last updated” date. Continued use of the Mentor after a change takes effect constitutes acceptance of the revised terms.
14. General
Any controversy or claim arising out of or pursuant to or related to these Terms, their effectiveness or subject matter will be resolved in accordance with the dispute resolution mechanism agreed in the applicable Agreement; or if no such Agreement applies, you and Skillable submit to the exclusive jurisdiction of the courts of Hillsborough County, Florida. These Terms will be construed under and controlled by the laws of the State of Florida.
A waiver of any right or remedy under these Terms or by law is only effective if given in writing and will not be deemed a waiver of any subsequent right or remedy. A failure or delay by a party to exercise any right or remedy provided under these Terms or by law will not constitute a waiver of that or any other right or remedy, nor will it prevent or restrict any further exercise of that or any other right or remedy.
If any provision of these Terms is or becomes invalid, illegal or unenforceable, it will be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision will be deemed deleted. Any such modification or deletion will not affect the validity and enforceability of the rest of these Terms.
Any suggestion, comment, improvement, idea, enhancement request or feedback provided by you with respect to or relating to the Mentor may be used by Skillable without compensation or attribution to you or anyone, and in connection therewith, You grant Skillable a perpetual, irrevocable, royalty-free, unrestricted right to use any or all of the foregoing.
By using the Skillable AI Mentor, you acknowledge that you have read and agree to these Terms and Conditions.
